Addressing Legal Concerns Of Same-Sex Couples And Domestic Partners

In June 2015, the U.S. Supreme Court ruled that the Constitution guarantees a right to same-sex marriage in all states. This affords individuals in same-sex marital relationships the same rights provided to those in traditional marriages, including health benefits provided to spouses through employer-sponsored coverage.

It also means that same-sex partners living in Texas who were lawfully married in other states can now get divorced here. Prior to the Supreme Court ruling, Texas courts did not legally recognize same-sex marriages.

The experienced family law attorneys at Mackoy, Hernandez, Jones and Woods LLP, represent LGBT clients in the full range of family law issues that arise from same-sex relationships. Married same-sex couples are now subject to the same Texas laws regarding child custody, property division, child support, spousal support and all other areas of family law.

Knowledgeable Guidance For Adoptions And Second-Parent Adoptions

Many same-sex couples wish to adopt a child, or one spouse wants to legally adopt a partner’s biological child. Second-parent adoption protects the non-biological parent’s rights and relationship with a child.

We facilitate many types of adoption. Adoption requires that both parents complete a background check and a pre-adoptive home screening. We help couples navigate the adoption and second-parent adoption processes.

Domestic Partnership Agreements Specify Property Division And More

Many same-sex partners who cohabitate but who are not married wish to create domestic partnership agreements. These agreements clarify the division of property if the relationship ends and also frequently address beneficiary status and the right to make financial or health care decisions on a partner’s behalf if that person becomes incapacitated.
